Ergün K., who was taken into custody, was arrested after the prosecutor’s statement and put in prison. A lawsuit was filed against Ergün K. in Istanbul Anatolian 9th High Criminal Court for the crime of “qualified sexual assault against a person who is unable to defend himself in terms of body or spirit”, demanding a prison sentence of up to 12 years.
‘We can be victims, take measures’
While the criminal case related to the incident was continuing, a lawsuit for compensation was filed against Ergün K. in Şile Civil Court of First Instance by the family of the victim. In the first hearing of the case, the victim’s lawyer demanded that Ergün K.’s property be imposed precautionary attachment, arguing that he was going to dispose of the properties registered on him, and that if this happens, the family may become a victim in the future. Evaluating the request, Şile Civil Court of First Instance ruled that the assets of the defendant Ergün K. shall be imposed with a precautionary lira of 110 thousand liras.

The lawyer İhsan Yalçınkaya stated that the precautionary attachment order issued by the court is an example for the non-pecuniary damages filed for sexual abuse and said, “The court made a proper decision and prevented any future damage by placing a precautionary foreclosure on the property of the accused. This decision sets an example for similar cases ”.
